We have designed our website so that you can visit Theia on the web without identifying yourself or revealing any personal information. Once you have chosen to provide us with personally identifiable information (any information by which you can be identified), you can be assured that it is not displayed online and it is not accessible to the general public. Your personal information will be used solely for the purpose of order processing and personalization only. Theia strives to have consistent privacy practices for your personal information regardless of the medium used to collect the information. Therefore, this privacy policy applies to all online, offline and manually processed personal information.

What we collect

When you place an order with Theia, we collect your contact and billing information so that we may send you an order confirmation, provide you with information regarding your purchase(s) and for the purpose of delivering your package. Financial information (such as credit card numbers and billing address) is used for payment processing only and is not retained for any other purpose. This information is submitted through secure methods (SSL) and is stored under encryption. We do not share this information with any other parties.

How we use the information

Theia uses your information to help us understand your needs and interests and provide you with better services. We use your information to help you complete a transaction or order, to communicate with you, to provide service and support, to update you on services and benefits and to personalize promotional offers. Credit card information is used only for payment processing and fraud prevention and is not used for other purposes.

Data collection online may also be combined with information you provide through other sources such as trade shows or seminars.

Occasionally, we may also use your information to contact you for market research or to provide you with marketing information we think would be of particular interest. We will always provide you with the opportunity to opt-out of receiving communications from us.

Who we share it with

Theia Technologies will not sell, rent or lease your personally identifiable information to others. Theia will not share your personal information with a business partner or any unrelated third-party company unless you give your permission.

We protect the personal information you share with us. Access to your personal information is limited to authorized personnel. Authorized third-party agents may also need access to some of your personal information for the purposes of shipping or repair. We only provide third-party agents with the minimum amount of information needed to complete the requested service. We do not otherwise share your personal information with third parties, unless we have your permission.

Theia may respond to subpoenas, court order, or legal process. We also may choose to establish or exercise our legal rights or defend against legal claims. Theia may also collect and share information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of a person, violation of Theia' terms of use, or as otherwise required by law.

Choice

Theia will not use or share the personally identifiable information provided to us online in ways unrelated to the ways described above without offering you a choice. We also provide you the opportunity to let us know if you wish to opt-out of partial or all contact from Theia and we will do everything we can to honor such requests. Security

Theia Technologies is committed to ensuring the security of your information. To prevent unauthorized access or disclosure, maintain data accuracy and ensure the appropriate use of information, we have put in place appropriate physical, electronic and managerial procedures to safeguard and secure the information we collect from you online.

All credit card information is submitted online is protected using SSL encryption (the internet standard for secure transactions) or if you prefer, you can telephone or fax your card information to us. Your online order information and purchase history are protected by a password that you set. If you forget this password, we will first verify your identity then e-mail your password to the e-mail account you specified at the time of registration.

This sale is subject to the terms and conditions set forth below, which supersede any and all terms and conditions set forth in any documents issued by Purchaser, including Purchaser’s purchase order. No waiver or amendment of these terms and conditions shall be binding unless made in writing and signed by Theia Technologies.

Installation

The operator’s manual that arrives with the lens contains important installation, use, and maintenance information including the requirement to invert the camera or image and keep the focus set to the NEAR position during installation. Theia Technologies’ Linear Optical Technology which allows the ultra wide angle lens to maintain very low distortion inverts the image. This requires the camera to be mounted upside down or the image to be inverted electronically. Refer to your camera’s operator’s manual to invert the camera or image. The lens will arrive with the focus set to the NEAR position. Keep the lens in this position during installation to avoid possible interference between the lens and IR cut filter of the camera. After installation, the lens can be focused normally.

Payment

Payment shall be in U.S. Dollars, and shall be due and payable in accordance with the terms set forth on the applicable Theia Technologies Quotation. Payment shall be in an amount equal to the purchase price for the applicable Product plus all applicable taxes, shipping charges, and other charges to be borne by Purchaser.

Shipment and Risk of Loss

All Products shipped by Theia Technologies shall be packaged in Theia Technologies shipping cartons so as to prevent damage and shall be delivered to a common carrier FCA Theia Technologies facilities in Wilsonville, OR, USA, or FCA Bogor, Indonesia at which time risk of loss shall pass to Purchaser. All freight, insurance, and other shipping expenses, as well as expenses for any special packing requested by Purchaser and provided by Theia Technologies, shall be paid by Purchaser.

No further export

Products sold by Theia may be exported from the United States only in accordance with the Department of Commerce’s Export Administration Regulations (EAR). Diversion contrary to United States law is prohibited. You warrant and represent that you are eligible to receive Products under United States law and agree to abide by any export or re-export restrictions. Theia may discontinue shipping to one or more countries at anytime without notice.

Warranty

Theia Technologies warrants its video camera lenses, when purchased new, to be free from manufacturing and material defects. Theia Technologies, at its option, will repair or replace a defective video camera lens for a period of 2 years after purchase by the original buyer for covered defects. Shipment for warranty service must be accompanied by a return merchandise authorization (RMA) number which must be obtained from Theia Technologies. Shipment to Theia Technologies will be paid for by the customer. Shipment after repair, replacement, or return to customer of un-repaired lens will be paid by Theia Technologies and shipped by ground service unless the customer requests and pays for expedited shipping charges.

Returns

Returns will only be accepted within 30 days after the purchase by the original buyer, subject to a 20% restocking fee. Shipment for returns must be accompanied by a return merchandise authorization (RMA) number which must be obtained from Theia Technologies. Theia Technologies will send a prepaid shipping label via email or first class mail to be affixed to the original shipping box or a box offering equivalent shipping protection as the original shipping box. All returned equipment must include all accessories and documentation included in the original shipment and the original containment box.

Out of warranty repairs

The customer will pay for shipping to Theia Technologies for an estimate for repair. Theia Technologies will provide a quotation for repairs to the customer via email or first class mail. The quotation must be signed and returned before repairs can be started. The quotation will include shipping by ground service back to the customer. Other shipping options are available at additional cost. If the quotation is not accepted and the customer requests the lens be returned, the customer must pay for shipping and handling to return the lens.

Warranty after repair

After any repair the lens will be warranted to be free of defects from manufacturing and materials for 90 days effective from the date of shipping. Any remainder of the original 2 year warranty will be forfeited.

Limitations

This warranty does not cover equipment that has been installed incorrectly, altered from its original state, abused, misused, or accidentally damaged. This warranty does not cover damage during shipping. Minor defects such as dents and scratches that do not affect lens performance will not be covered under this warranty.

No further warranty

Theia Technologies makes no further warranty, expressly or implied, including merchantability or fitness for a particular application. In no event shall Theia Technologies be responsible for consequential or incidental damage or loss due to the use of Theia Technologies’ equipment. The customer agrees that the sole and exclusive maximum liability of Theia Technologies arising from any product sold by Theia will be the price of the product ordered. To the maximum extent permitted by law, Theia and its suppliers will have no liability to the customer or any third party for any indirect, special, incidental, punitive, and/or consequential damages, even if advised of the possibility of such damages.

General Provisions

Notwithstanding any other provision hereof, performance by Theia Technologies shall be excused to the extent that performance is rendered commercially unreasonable by acts of God, war, fire, flood, riot, power failure, embargo, material shortages, strikes, governmental acts, man-made or natural disasters, earthquakes, failure of limitation of supply, or any other reason where failure to perform is beyond the reasonable control and not caused by the negligence of Theia Technologies. The time for performance shall be extended for time period lost due to the delay. This Agreement shall be governed by and construed under the laws of the State of Oregon, USA, without reference to conflict of laws. These terms and conditions set forth the entire agreement. and understanding of Theia Technologies and Purchaser with respect to the sale and distribution of Products between the parties.

The use of this site is governed by these terms and conditions. Please read them carefully. Your use or placement of any order indicates your acceptance of these terms and conditions. These terms and conditions represent the full and complete agreement between Theia Technologies ("Theia" or "we") and our customer ("you"), and supersede any subsequent terms or conditions included with any correspondence, whether or not such terms or conditions are signed by Theia. These terms can only be modified in a writing signed by a Theia Vice President. Theia reserves the right to make changes to this site and these terms and conditions at any time without notice.

ERRORS

In the event a product is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, or the product is no longer available, Theia will have the right to refuse or cancel, without liability, any orders placed for product that is no longer available or is listed at the incorrect price. Theia will have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Theia will immediately issue a credit to your credit card account in the amount of the incorrect price.

SYSTEM AVAILABILITY

Theia makes every reasonable effort to maintain 100% system availability, except during scheduled maintenance periods. Should we experience technical difficulties, Theia is not responsible for orders that are not processed or accepted.

JURISDICTION AND VENUE

The Theia website is administered in Oregon, USA and all orders are deemed to be solely performed in Oregon, regardless of where you are located. You agree that any legal action brought against Theia will be governed by the laws of the State of Oregon without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Theia site will be an appropriate federal or state court located in Clackamas County, Oregon, USA. Any cause of action must be brought within two (2) years form the date that the cause of action arose.

FRAUD

Fraud hurts us all, and we will prosecute fraudulent ordering to the fullest extent of the law. It is a violation of the law to place orders under a false name or with an invalid credit card. We have a sophisticated fraud control system that screens for suspicious orders. All orders are subject to investigation and verification, and possible cancellation. To protect our customers, orders that cannot be verified as legitimate will be cancelled and the customer/cardholder notified. The FBI is responsible for investigating fraud cases. This policy applies to orders placed online and by phone.

GENERAL

Theia will not be responsible for damages or delays resulting from events beyond our reasonable control, including but not limited to acts of God, supplier delays, technical difficulties, strikes, shipper delays, technical difficulties, weather, earthquakes, war, and any governmental acts.
